KNOW ALL MEN BY THESE PRESENTS: WHEREAS, by Deed of Trust bearing date of the 24th day of May, 2013, of record in the Register's Office of Johnson County, Tennessee, in Trust Deed Book 275, at page 92, George E. Shalar and Tessie L. Gregory, did convey to George T. Wright, Trustee, certain real estate to secure the payment of an indebtedness owed to Farmers State Bank and as stated in the said Deed of Trust, and WHEREAS, the Deed of Trust provides that in the event of default of payment of the said debt secured by the said Deed of Trust and/or interest when due, the entire indebtedness shall, at the option of the Noteholder, become due and payable, and WHEREAS, the Grantors of the Deed of Trust and the Makers of the said Note have failed to make payments as they became due, and the Owner of the Note secured by the Deed of Trust has accelerated and demanded the entire balance of the indebtedness so owed and as provided for under the Note and Deed of Trust; and WHEREAS, by reason of default and acceleration of the debt made, the entire debt is now due and the Holder and Owner of the said debt and the Note evidencing the same has demanded the entire balance now due and payable and has instructed the undersigned Substitute Trustee to foreclose the Deed of Trust. Wright, Trustee, by Deed of Trust dated the 24th day of May, 2013, of record in the Register's Office of Johnson County, Tennessee, in Trust Deed Book 275, at page 92, and more particularly described as follows: BEGINNING at a point witnessed by an iron pin set in a general northern and/or eastern edge of the roadway and/or right-of-way of the Burley Shoun Road, corner to Eichhorn: thence, a series of divisioning and portioning lines with the property of Eichhorn as follows: north 45°, 00', 00" east, 220.00 feet to a stake; thence, south 27°, 15'. 14" east, 170.78 feet to an iron pin set; thence, south 47°, 02', 00" east, 12.25 feet to a point in the general center line of an existing drive and/or road; thence, with the general center line of the existing road, south 42°, 58' west, 94.66 feet to a point; thence, thence, south 62°, 00' west, 78.31 feet to a point; thence, south 42°, 27' west, 69.01 feet to a point in the general center line of the Burley Shoun Road; thence, with the general center line of said road as follows: north 61°, 18' west, 82.16 feet to a point; thence, 01°, 25', 00" west, 115.47 feet to a point; thence, leaving the center line of the Burley Shoun Road, north 61°, 39', 11" east, 9.10 feet back to the point of BEGINNING, containing 1.00 acre, more or less, as surveyed by Appalachian Land Survey, date of July 1, 1997, said plat attached hereto as an Exhibit to this Deed of Trust to which reference is made for further description. EXCEPTING and RESERVING from the above property in easement fashion is any part or portion thereof constituting the roadway and/or right-of-way of the Burley Shoun Road, and/or the existing road, the center line of which constitutes the general southeastern boundary of the above property; however, ALSO CONVEYED herewith in easement fashion is the right to the use of the existing roadway as a means of egress and ingress in and to the said property. The above property shown on Map 46, Parcel 105.09, Tax Maps, Johnson County Assessor's Office. The above property having an address of: 796 Burley Shoun Lane, Mountain City, TN 37683.
