Man sentenced to eight years after guilty plea on child porn

ELIZABETHTON — A Carter County man entered guilty pleas in Carter County Criminal Court on Monday on two counts of especially aggravated sexual exploitation of a minor.

Judge Stacy L. Street sentenced Joshua Hewlett Herman, 30, 264 Rockhouse Road, Johnson City, to eight years on each of the two counts, to run concurrently. Under state law, Herman will be required to serve 100 percent of the eight years. He will be given credit for the year served in pretrial confinement.

The charges stem from child pornography found on Herman’s cell phone, authorities say. The arrest came after a woman told deputies that Herman had been her boyfriend. The woman said she noticed him deleting photographs from his cellphone.

She told deputies that she took the phone and discovered he was sending three emails containing three photographs that depicted Herman lifting the underwear on her young daughter so that the child’s genitals were clearly visible.

The woman told deputies that Herman then fled the scene, leaving his cellphone behind. She turned the phone over to the deputies, who placed it in evidence.
