Michael A. Nolan's probation officer has the discretion of imposing a 90-day jail sentence during his three years of probation. Nolan, 33, of 3930 Ohio 601, would serve the term on the work-release program.
On Aug. 12, Nolan returned home to discover there had been a possible burglary and called the Norwalk Police Department.
"Obviously this is a very odd case. He reported the burglary and police arrived," said Huron County Prosecutor Russell Leffler, who noted the burglary complaint was legitimate.
During the investigation, officers discovered a spoon with heroin residue.
"The defendant attempted to palm the same. He put it in a glass of water to hide it from police," Leffler said. "The Norwalk Police Department confronted him about it and the defendant was very honest about (what he did)."
