ELIZABETHTON — A Sullivan County man has been arrested on a Carter County grand jury presentment charging him with theft over $10,000.
Frank Edward Small, 53, 116 Spring Drive, Kingsport, turned himself in to the Carter County Sheriff’s Office earlier in the week. Sgt. Harmon Duncan said the charge stems from a paving scam that has been used for years in the region.
The presentment said Small and Richard Donovan Adams II, who has also been arrested in the case, did exercise control over $13,200 belonging to Bruce and Rosemary Shields on or about April 21.
Duncan said Small is also facing a charge of violating the licensing law in Scott County, Va. and is being investigated in Hawkins and Sullivan County.
“The cases usually target elderly people,” Duncan said. “They offer a good deal to patch a small portion of a driveway and before the homeowner knows it, they have paved the whole driveway. It used to only be a civil case until the law was changed a couple of years ago.”
Duncan said the new law requires a contractor who has made a verbal or written agreement with to get an authorization before significant changes are made in the agreement.
