Accused killer’s brother bound over on charge of threatening 12-year-old witness

A Johnson City man accused of threatening a 12-year-old girl who reportedly witnessed a murder his brother is charged with committing was bound over to a grand jury on coercion charges and an unrelated robbery of a tobacco outlet.


Josh Gergish, 30, 1206 Flora Ave., was in Washington County Sessions Court on Tuesday for a preliminary hearing on the charges — three counts of coercion of a witness and one count each of aggravated robbery, evading arrest, resisting arrest and simple possession of marijuana.


During the hearing, the victim of the alleged coercion testified that she used to live in the same apartment complex as Gergish and had played with his son on occasion. The girl also testified she witnessed an April 3 shooting in which Timothy Peregoy Sr. died.


Gergish’s brother, Marcus Gergish, is charged with Peregoy’s murder.


“She testified she witnessed the Peregoy shooting and has been interviewed by police related to that,” Assistant District Attorney General Michael Rasnake said.


“She testified (Josh Gergish) drove by and said, ‘I’m going to kill your daddy, you snitches,’ ” Rasnake said.


The alleged incidents occurred at the apartment complex where Marcus Gergish, 34, also of 1206 Flora Ave., is accused of gunning down Timothy Peregoy Sr. in the parking lot after an alleged drug transaction April 3.


According to a court affidavit, Johnson City Police Investigator Joey Whitlock was at the complex conducting interviews related to Peregoy’s death April 18 when the 12-year-old came running into the apartment of her godmother, where Whitlock was, in a panic. She told police Josh Gergish was a passenger in a car that drove past where she was playing outside and pointed at her with his fingers in the shape of a gun.


On another occasion later in April, the girl said Josh Gergish was driving through the complex, and the vehicle had followed her and a friend until they sought refuge in another apartment.


In the robbery case, police said Josh Gergish robbed Discount Tobacco, 2608 W. Market St., on July 18. Officers responded there around 9 p.m. after a clerk at the tobacco store called and said a man pulled a knife on him and demanded money.


Gergish allegedly ran from the store with $303 in cash. An eyewitness to the robbery later identified Gergish as the person who held up the store, according to police.


Gergish was later located at his residence, but he ran from police. Officers chased him down and made the arrest a short distance away.


Officers were already looking for Gergish for the coercion charges.


Josh Gergish remains jailed on $50,000 bond. He will appear in Criminal Court in September.
