A Johnson City woman charged in a 2009 fatal traffic crash will plead guilty to a lesser charge in October, according to statements made in a Washington County courtroom Tuesday.
Rachel M. Proffitt, 26, now stands charged with vehicular homicide by reckless operation of a vehicle that stems from a two-vehicle crash on Conklin Road on July 7, 2009.
The collision killed Misty M. Briggs, 22, of Jonesborough.
“We have a plea agreement,” to criminally negligent homicide, Proffitt’s attorney, Don Spurrell told Judge Robert Cupp.
Apparently Proffitt fell asleep while driving north on Conklin Road around 8 on the morning of the crash and drifted across the center line into the path of a car driven by Thomas Briggs, of Jonesborough.
Briggs swerved to miss Proffitt’s car, but Proffitt also apparently swerved back toward her own lane and the cars crashed at the center line.
Misty Briggs was a front seat passenger in Thomas Briggs’ car, and while she was wearing a seat belt, she was killed in the crash.
Proffitt failed to appear at a hearing last year and was arrested, but is now free on bond.
Her plea hearing is now scheduled for Oct. 31.
